Terms of service

You must be at least 18 years old and legally able to enter into a contract. If you use the service on behalf of a company or of a farm that is not yours, you declare that you are authorized to accept these terms on its behalf.

We grant you a limited, personal, non-transferable license to use our products to manage your operation. You must use them in accordance with the law and these terms.

You are responsible for keeping your credentials confidential and for the activity on your account. An account can own one or more farms and be a member of others by invitation. The owner of each farm decides who joins and with which role, and answers for the invitations they send, including the age of the people they invite.

You must not attempt to breach the security of the service, access other farms' data without authorization, or use our products for unlawful purposes or to harm third parties.

Nor may you resell, rent, or share access to the service. You may not copy it, decompile it, or reverse engineer it. You may not extract information with automated programs outside the export features, or use the service to build a product that competes with ours.

The software, design, trademarks, and calculation models of our products belong to ProData Livestock. These terms do not transfer any of those rights to you, only the license to use described above. Your farm's information remains yours.

Your farm and herd information is yours. We process it according to our Privacy policy. You can export it, and delete your account and your data, at any time from our products.

If you send us ideas or suggestions about our products, we may use them freely, without paying or crediting you. Do not send us anything you consider confidential that way.

Lactation curves, IOFC, alerts, and the other calculations are decision-support tools. They do not replace professional judgment or veterinary advice. Management decisions are yours.

Our products may link to third-party sites or services. We do not control them and are not responsible for them. Their use is governed by their own terms and policies.

We work to keep the service available, but we do not guarantee it will run without interruptions. We may perform maintenance. When it is foreseeable, we will give notice beforehand. If we decided to stop offering the service, we would give you at least 90 days' notice so you can export your data.

We may update these terms. We will email you at least 15 days before a change takes effect. If you disagree, you can close your account before that date, at no cost and with no penalty. If you keep using the service after that date, you accept the new version.

We are liable for the damage caused to you by a breach on our part. To the extent permitted by law, we are not liable for indirect damages or for the management decisions you make based on the service's metrics. This limitation does not apply to damage caused by willful misconduct or gross negligence, nor to anything the law does not allow to be limited.

You can close your account whenever you want, from the product, in the same way you created it and with no penalty. We may suspend or close your account if you breach these terms. We will tell you why. Apart from that case, we would only close accounts when discontinuing the service, with the prior notice described above.

We send notices about these terms by email, to your account's address, or inside the product. Those notices count as written communication.

The consumer protection and personal data laws of the country where you live apply to you. Nothing in these terms takes away the rights those laws give you, or your right to turn to the authorities and courts of your country.

If a court declares a clause of these terms void, the others remain in force. If at some point we do not enforce a clause, we do not waive it.

We may assign these terms to another company that continues the service. We will notify you by email. You may not assign them without our written permission.

These terms and the Privacy Policy are the entire agreement between you and us about the service.
